From asylum seeker to political prisoner

Ivan Apaolaza Sancho came to Canada in 2001, hoping to escape the political repression against the Basque nationalist movement in Spain. Instead, he was imprisoned without trial for 16 months, labeled a security threat, denied the right to apply for refugee status in Canada, and deported to Spain on 18 October 2008. All on the basis of information that a Canadian tribunal recognized was probably obtained under torture.

This photo-essay shows some parts of his struggle for security, freedom and justice in Canada.

In November 2007, Ivan's lawyers ask to have the case thrown out because no evidence had been filed to support the government's claims. The government has only submitted Spanish arrest warrants, with no proof to back them up. Two-tiered justice at work.

In January 2008, the motion to throw out the case for lack of evidence is rejected and the case proceeds. Not one piece of evidence supporting the allegations against Ivan is ever filed by the government.

May 2008. IRB Commissioner Louis Dubé rules that Ivan is 'inadmissable' to Canada on security grounds. Dubé recognizes in his decision that Ana Belen's "confession" was probably obtained by torture.

September 2008. Action outside Superior Court of Quebec. Never charged with any crime in Canada, Ivan asked for habeas corpus after more than a year in prison. He is refused because he is not a citizen.
